Dual board-certified orthopedic surgeon: American Board of Orthopaedic Surgery (ABOS) and Fellow of the Royal College of Physicians and Surgeons of Canada (FRCSC) with 21 years of post-training experience spanning academic medicine and private practice. I provide expert witness services, independent medical evaluations (IMEs), record reviews, causation and standard-of-care opinions, deposition testimony, and trial testimony for both plaintiff and defense counsel, with a deliberately balanced 50/50 case mix.
AREAS OF EXPERT OPINION
Orthopedic trauma and musculoskeletal injuries: fractures, dislocations, sprains, polytrauma, motor vehicle collision injuries, workplace injuries, slip-and-fall injuries, and post-traumatic complications. I remain in active clinical practice, taking orthopedic trauma call at three busy hospitals, treating these injuries daily.
Hip and knee replacement (arthroplasty) complications: I am the surgeon other surgeons refer to when joint replacements fail. I routinely evaluate and surgically manage periprosthetic infection, periprosthetic fracture, implant loosening and failure, instability and dislocation, persistent pain and stiffness, nerve and vascular injury, and revision arthroplasty. This gives me direct, current, operative-level insight into standard of care, causation, and whether a poor outcome reflects negligence or a known complication.
Orthopedic oncology: fellowship-trained in bone and soft tissue tumors, including osteosarcoma, Ewing sarcoma, chondrosarcoma, soft tissue sarcoma, metastatic bone disease, and pathologic fractures. I offer opinions on delayed diagnosis and misdiagnosis of cancer presenting as musculoskeletal complaints, biopsy errors, and treatment of malignant and benign bone and soft tissue lesions.

I have completed more than 100 independent medical evaluations in personal injury, motor vehicle collision, and musculoskeletal injury claims. I have testified at trial as a qualified orthopedic expert in both the United States and Canada, have given depositions with additional depositions scheduled, and have extensive experience preparing clear, defensible written reports. I review every case before accepting an engagement to confirm I can render an objective, evidence-based, unbiased opinion.

I am the founder and owner of DFW Orthopedics, a busy and growing practice in the Dallas–Fort Worth metroplex (Southlake and Fort Worth, Texas). I was recruited to Texas specifically for my expertise in orthopedic oncology and complex hip and knee reconstruction, and the majority of my clinical referrals come from other orthopedic surgeons seeking help with their most difficult cases.
Prior to private practice, I spent 12 years in academic orthopedic surgery in Canada at the University of Toronto and McMaster University, achieving the rank of Associate Professor, with more than 100 scholarly publications and presentations. This academic foundation means my opinions are grounded in peer-reviewed literature and withstand rigorous cross-examination.

- Q: What is your hourly rate to consult with an attorney?
- A: $700 per hour. An initial case screening call of up to 20 minutes is provided at no charge to determine whether the matter falls within Dr. Deheshi's areas of expertise and whether any conflict exists. Initial case consultation and evaluation of up to one hour is billed at $700 flat.
- Q: What is your hourly rate to review documents?
- A: $700 per hour for detailed record review and analysis, medical literature review and research, and preparation of medical-legal reports. Flat-fee options are also available for predictable cost on routine file review: medical record review up to 250 pages with written report at $1,200 flat, with additional pages over 250 billed at $2 per page. Rush review within 48 hours is $2,400 flat up to 250 pages. Supplemental or addendum reports are $800 flat. Imaging review of X-ray, MRI, or CT is $800 flat.
- Q: What is your hourly rate to provide deposition testimony?
- A: Fee $1,100 per hour, two hour minimum. Evening depositions after 6:00 PM and weekend depositions are billed at $1,700 per hour. Deposition preparation time is billed at $700 per hour.
- Q: What is your hourly rate to provide testimony at trial?
- A: Trial testimony is billed by the day rather than hourly. Half-day testimony of up to four hours is $5,000, and full-day testimony of up to eight hours is $9,500. Trial preparation and consultation is billed at $700 per hour, and standby or on-call availability is $3,500 per day.

- A: Independent medical examinations are billed at $1,500 flat for a standard single-region uncomplicated examination and $2,500 flat for a complex examination involving multiple regions, post-surgical presentations, or complicated cases, each inclusive of the clinical evaluation and physical examination. IME report preparation is $700 per hour.
Additional services include document organization and administrative review at $200 per hour, document production and legal correspondence at $200 per hour, and subpoena response and record processing at $100 to $200.
Travel time is billed portal to portal at $500 per hour plus expenses. Airfare, hotel, meals, and ground transportation are billed at actual cost, with mileage reimbursed at the current IRS rate for distances over 50 miles. Travel expenses require advance approval and either prepayment or reimbursement.
Retainer requirements: a retainer is required before record review work begins. Independent medical examinations require full payment or retainer five business days prior to examination. Depositions and trial testimony each require a 50 percent retainer seven calendar days prior to the scheduled date. A retainer may be required on complex cases at Dr. Deheshi's discretion.
Cancellation policies: IME cancellations with less than five business days notice incur a $750 fee. Deposition cancellations with less than ten business days notice incur a $2,200 fee. Trial cancellations with less than ten business days notice are charged the full reserved rate of $5,000 for a half day or $9,500 for a full day.
Payment terms: all fees are payable to Dr. Ben Deheshi Orthopedics PLLC. Hourly charges are billed in 15-minute increments. Payment is due within 30 days of invoice date. Balances outstanding over 30 days accrue a late payment fee of 1.5 percent per month.
