WHAT IS A VOCATIONAL EXPERT (VE)?
A VE is a vocational professional who provides impartial expert testimony & evidence about an Assessee’s vocational ability which testimony law judges consider when making decisions involving disability, injury, & return to work (earnings capacity). VEs testify by Affidavit, in person, over the phone, &/or by video teleconferencing (VTC), & VEs attend hearings. VEs sometimes provide testimony in writing by answering written questions called interrogatories.
ATTENTION TO VE QUALIFICATIONS
One or more professionals posing as Vocational Expert at Jurispro is/are not fully qualified to do so.
A qualified VE is trained in the medical aspects of disability, Transferrable Skills Analysis (TSA), Vocational Measurement & Assessment, Standardized Testing (to test Psychological IQ, residual scholastic aptitude or achievement, work personality, & the effects of disability on behavior) sufficient to evaluate the medical record & formulate expert opinions about a claimant’s Residual Functional Capacity (RFC). A Vocational Expert must always request & evaluate the Assessee’s medical record to ascertain or rule out disability as required in Vocational Assessment. Failure to do so is an ethical violation that poses liability concerns.
A qualified VE should classify past relevant work in terms of Specific Vocational Preparation (SVP) & exertional level (strength), along with the traditionally anticipated Standard Occupational Classification (SOC) & Dictionary of Occupational Titles (DOT) Codes to allow fair comparisons between opposing VE Affidavits. A Human Resources Degree is not a Vocational Expert credential. Human Resources & Vocational Rehabilitation are two vastly different fields. Human Resources is about organizations, managing (hiring & terminating) staff (employees). Vocational Rehabilitation is about disability, evaluating the work & earning capacities of people with functional limitations to assess their Residual Functional Capacity (RFC) in relation to the world of work. Vocational Expert requirements include a Master’s in (Vocational) Rehabilitation Counseling, psychology, or a closely related human service field, usually a counseling field.
Unqualified individuals posing as Vocational Experts must be prosecuted because of the potential of causing claimants with severe disabilities to wrongfully lose their cases, thereby defrauding them of their due compensation & benefits where without such, there is the risk of exacerbated illness & death on the part of disabled victims in cases when, such wrongfully defrauded claimants cannot afford their necessary medications & medical treatments. This & other types of administrative-adjudicative corruption are discussed in my Doctoral Dissertation, “Administrative-Adjudicative Stakeholders’ Perceptions of How to Diminish Administrative-Adjudicative Corruption,” available at the link below in which one or more deaths have been recorded due to corruption.
Because of these ethical, personal injury, & liability concerns, Attorneys & all others seeking Vocational Assessment / Evaluation / Earnings Capacity must be especially careful to choose a fully qualified Vocational Expert: One with at least a masters-level education in (Vocational) Rehabilitation Counseling, psychology, or a closely related human service field. Human Resources is not considered a human service field. A Human Resources Degree is not a Counseling Degree. Disability & counseling are critical components in the practice of Vocational Rehabilitation & Expertise; the whole purpose of Vocational Rehabilitation is to assess & rehabilitate individuals with disabilities & injuries for integration into the labor market or, when appropriate, to determine claimants too severely disabled to perform work on a substantial gainful level [to achieve Substantial Gainful Activity (SGA)]. Whereas not all courts require the 5-step Sequential Evaluation Process (SEP), a qualified Social Security Disability (SSD) VE will apply the 5-step SEP. A qualified SSD VE will be experienced in job placement, job coaching, & job accommodations in order to afford people with disabilities the same rights as all others under the United States Constitution, its Amendments, & other federal disability law including but not limited to the Rehabilitation Act of 1973, the Americans with Disabilities Act (ADA), the Workforce Innovation & Opportunity Act (WIOA), & the Social Security Act Titles II & XVI, Social Security Disability Insurance (SSDI) & Supplemental Security Income (SSI) respectively.

USE SKILLTRAN OES GROUPS, BECAUSE OES GROUPS ARE OBSOLETE. BLS SOC GROUPS have replaced DOT OES GROUPS. DMFT relied on state labor market data information systems for singular “DOT” or job title numbers. State labor market data information systems (ONET) is a most appropriate resource for assessing job numbers.

SkillTran Job Browser Pro (JBP):
SkillTran JBP relies on the outdated DOT, last updated in the 1970s through early 1990s & replaced by the SCO & ONET. Since DOT codes were last generated in the 1990s, the Bureau of Labor & Statistics does not determine the number of singular DOTs contained in any given OES Group so that JBP is outdated. Although SkillTran states that it updates its data annually, SkillTran is unable to estimate an accurate number of singular jobs contained in each OES Group on the current labor market because the DOT is no longer valid. Instead, the most reliable TAXONOMY DATA currently available is at: https://www.onetcenter.org/taxonomy.html. SkillTran methodology for estimating employment numbers for each DOT code is error-laden as discussed below under SSA DISABILITY DETERMINATION CONCERNS. Although both the DOT & JBP should be eradicated from SSA & Vocational Rehabilitation practice & the SSA reported they are discussing or in process of eliminating the DOT, I apply the DOT in my Vocational Expert (VE) Affidavits as a basis for comparison between opposing VE Affidavits & testimony because many VEs still use the outdated DOT & JBP. JBP relies on OES Groups. ONET does not acknowledge OES Groups. JBP does not accurately account for new & diverse jobs within the OES/SOC Groups created from the 1990s to Present. This means that BLS national employment census data contains many new, diverse job titles JBP does not account in its calculation of employment numbers. If the new & diverse jobs had been (or, were) assigned DOT numbers accordingly, then the numbers in the OES Group would increase appropriately so that when SkillTran uses its already erroneous method of dividing the national numbers by the number of jobs in the OES Group, we would obtain a much smaller number of jobs on the national economy for any singular DOT. Therefore, any & all employment numbers generated by SkillTran JBP are erroneous on today’s market. I left voicemail with SkillTran’s Owner / Originator, Jeff Truthan, inquiring how he arrives at an accurate number of jobs contained in the entire SOC Group today. SkillTran has consistently failed to return my calls (year 2013 to 2024) since I began questioning SkillTran methodology in 2011. Although already reported many times prior, I emailed this clause to SkillTran on 10/28/2025 with a staunch warning requesting JBP withdrawal & public apology & alert because SkillTran’s error-laden system used by VE’s internationally have resulted in wrongful denials & may have resulted in deaths of victims as discussed below. The SSA, Attorneys, claimants, & all stakeholders must revisit disability determinations to confirm JBP & VE error & appeal for remands. I have collaborated & corresponded with stakeholders many times prior. Upon reconfirmation of continued corruption in 2025, I now consider initiating a class action lawsuit against SkillTran's Job Browser Pro for its error-laden software. From the time I notified SkillTran until now, it appears that they only recently began making subtle statements that call their software into controversy & question; they have not staunchly warned VEs against reporting JBP error-laden methodology & employment numbers fraudulently promulgated in VE testimony resulting in harmful, potentially death-causing fraudulent denials despite my vehement warnings.
I am also concerned about SkillTRAN Industry-Context Methodology. It appears that the industry-context method invites individual employers to contribute employment numbers data & to change SkillTran’s job numbers based on their knowledge of the industry; however, I may be mistaken on this part. If this is the case, since employers are not labor market information systems, this, too, would be an egregiously error-laden methodology. On 10/29/2025 & prior, I notified Attorney Aviva Brown who is in charge of the SSD Attorney list-serve requesting she post this information to the list-serve.
