A: My most recent case (2021-2022), I worked for the defense on a commercial trademark dispute for an orthopedic company. The arbitration panel found no trademark infringement with the defense team winning the case.

I was engaged to provide expert testimony on what drives purchasing decisions in the medical device sales and distribution market of orthopedic soft goods, including what buyers (sophisticated buyers such as medical products distributors, group purchasing organizations, integrated health delivery networks and medical providers as well as individual consumers) prioritize in selecting products. Additionally, I provided expert testimony around intricacies of issues that drive purchasing decisions such product functionality, price, quality, availability, delivery, warranty, HCPCS/PDAC coding considerations, and trade/brand name irrelevance to the purchasing decision. I also testified on the processes of HCPCS coding and the interplay between Medicare billing and the providers who submit for reimbursement and the effect this has on consumers receiving said HCPCS category products.
