Introduction

Martin Dirks has 30 years of experience as an institutional investor, with an emphasis on the technology industry. In addition to his expert witness practice, Marty currently serves as a Board Member for the City of San José Retirement System, a Senior Adjunct Professor of Finance at Golden Gate University in San Francisco and an advisor to early-stage technology companies. His investment and corporate experience enables him to assist clients with complex litigation, valuation and business strategy challenges. An enthusiastic educator, Marty communicates complex financial issues in intuitive ways so non-practitioners can clearly understand the issues.

Marty’s experience ranges from selection of public technology stocks with sole discretion for an $800 million long/short equity hedge fund portfolio to sourcing and due diligence of public and private company acquisitions for a Fortune 100 corporation. In addition, he has been an investment advisor to pension plans and endowments on asset allocation, manager selection and monitoring and other relevant institutional investment issues.

As an institutional investor, Marty has analyzed hundreds of publicly-traded corporations with accounting fraud or other misrepresentation for short selling and executed the resulting investment transactions. Marty is also an expert in the use of listed equity options, arbitrage and other absolute return hedge fund strategies.

Marty has a physics degree and worked on integrated circuit design and fabrication at Texas Instruments prior to attending Harvard Business School. After graduating from Harvard, Marty worked at Cooper Industries, at the time a publicly-traded Fortune 100 industrial equipment manufacturing company, focused on sourcing and acquiring synergistic businesses. Subsequently, he worked for Feshbach Brothers, Odyssey Partners, Harvard’s endowment and his own hedge fund managing long/short equity portfolios. At Harvard, he was the sole manager of a long/short technology equity portfolio that grew from $110 million to $870 million with audited annual returns of 43% over 5 ½ years. Over the same time period, the NASDAQ 100 index had a 30.4% annual return.

Marty has been fortunate to be affiliated with premier firms. Marty was a short seller for Feshbach Brothers, one of the largest and most successful short selling firms. Odyssey Partners was founded by Jack Nash and Leon Levy, two of the three founders of Oppenheimer and Company. Odyssey earned a net average annual return for its investors of 22 percent over 14 years, until the founders retired. As a portfolio manager at Harvard Management, Marty managed the technology stock portfolio for more than five years. Under the management of Jack Meyer, Harvard had one of the best investment records for any large institution, increasing assets from $4.8 billion and to $25.9 billion in 15 years and beating its benchmark portfolio by an average of 3.8% per year.
