Board Certified in Internal Medicine & Pulmonary Diseases with double Board Certification in Sleep medicine with more than 30 years of medical practice and 25 years of expert witness work. He has rendered opinions on a broad spectrum of respiratory disorders including COPD, asthma, lung cancer, Asbestosis and Mesothelioma. Extensive background in Sleep Disorders including Forencic Sleep Medicine, wherein sleep disorders may impact the courtroom with abnormal sleep behavior e.g. sexsomnia, confusional arousals, and somnolence impacting driver accidents and DWI charges.

Expertise includes three decades experience in caring for patients with a broad spectrum of pulmonary disorders, including Pneumonia, ARDS, Asthma, Industrial inhalation injuries, Asbestosis, Lung Cancer, Mesothelioma, Lymphoma, Respiratory failure, Pulmonary Rehabilation services, all forms of Lung Fibrosis, Extensive background in Critical Care Medicine. Recent successful defenses in DWI/DUI charges in which various respiratory and medical disorders mitigate DWI/DUI charges and result in dismissals of charges or acquittal.25 years of medical-legal consultant including independent medical exams, reports, depositions and court testimony through out the country for both plaintiff and defense attorneys.

SLEEP DISORDER & SLEEP MEDICINE
Experienced in all aspects of Sleep Disorders and double board certified in Sleep Medicine. Co-founder and past-president of the New Jersey Sleep Society. Founded and obtained accreditation for 5 sleep centers and currently Medical Director of Accredited Sleep Center. Since 1982 has evaluated more than 10,000 patients with a wide variety of sleep disorders. Expert in the field of Forensic Sleep Medicine wherein unrecognized sleep pathology may result in civil and criminal charges. Frequently called on to testify in cases where disorders such as Sleep Apnea , Narcolepsy and driver fatigue have contributed MVA and other accidents.These and other sleep disorders may mitigate charges of DWI/DUI and auto and other driver error contribute to both fatal and non-fatal accidents.

SEXUAL ABUSE AND BATTERY EXPERTISE
Parasomnias are a class of sleep disorders that result in abnormal behavior during sleep or during confusional arousals. Sexsomnia (sexual behavior during sleep) is a well recognized sleep disorder that has been shown to explain some cases of child and adult molestation charges. REM Sleep Behavior may explain some cases of assault & battery charges.

ACCIDENT RECONSTRUCTION & SAFETY
Drowsy driving is a major public health problem through out the world. Many thousands of fatal and non-fatal accidents take place each year related to driver fatigue and/or underlying sleep disorders. Dr. Penek currently works with several state agencies to screen for underlying sleep pathology.
